Terms of Service

1. Welcome to HushaBuy

HushaBuy is a peer-to-peer marketplace connecting parents who want to buy and sell gently used baby and toddler clothing and soft accessories (newborn-5T). By accessing or using HushaBuy ("the Platform"), you agree to these Terms of Service.

2. Who Can Use HushaBuy

You must be at least 18 years old and able to form a binding contract to use HushaBuy. By creating an account, you represent that all information you provide is accurate and complete.

3. Fees and Payments

For Sellers

• No Seller Commission: Sellers keep 100% of their listing price. HushaBuy does not charge sellers any commission or listing fees.
• Shipping Labels: Sellers are responsible for printing and affixing USPS shipping labels provided by HushaBuy after a sale. The cost of shipping is paid by the buyer.
• Payment Processing: Payments are processed through Stripe Connect. Sellers receive funds directly to their linked bank account or debit card, typically within 2-7 business days of the buyer confirming receipt.

For Buyers

• Marketplace Fee: Buyers pay a 12% marketplace fee plus $1.00 per order to support platform operations and trust & safety.
• Shipping Cost: Buyers pay the actual USPS shipping cost as calculated by our shipping partner (EasyPost) based on package weight, dimensions, and destination. HushaBuy passes through the exact carrier rate with no markup.
• Total at Checkout: Your total = Item Price + Marketplace Fee (12% + $1.00) + Actual Shipping Cost + Payment Processing (handled by Stripe).
• Payment Methods: We accept all major credit and debit cards through Stripe. Your payment information is securely processed and never stored by HushaBuy.

4. Listing Items

Sellers must accurately describe items and provide clear, honest photos. All listings must:

• Include accurate size, brand, condition, and material information
• Show the actual item being sold (not stock photos)
• Disclose any flaws, stains, wear, or damage
• Not include children's faces or identifiable features in photos
• Comply with our Prohibited Items Policy
• Price items fairly and meet our $5.00 minimum listing price

Sellers should provide package dimensions (length, width, height) and weight to ensure accurate shipping quotes for buyers. Default estimates will be used if not specified.

5. Buying Items

When you purchase an item, you agree to:

• Provide accurate shipping address information
• Complete payment through our secure Stripe checkout
• Inspect your item upon delivery and report any issues within 3 days
• Confirm receipt or report a problem through your order dashboard

6. Shipping and Delivery

• Seller Responsibility: Sellers must ship items within 3 business days of receiving a shipping label. Items must be packaged securely to prevent damage.
• Shipping Method: All orders ship via USPS. Tracking information is automatically provided to buyers.
• Lost or Damaged Packages: HushaBuy will work with sellers and buyers to resolve shipping issues, but sellers are responsible for items until confirmed delivered.
• Delivery Confirmation: Buyers should confirm receipt within 3 days of delivery. If no action is taken, the order is automatically confirmed after 7 days.

7. Returns and Disputes

3-Day Acceptance Window: Buyers have 3 days from delivery to report issues:

• Item significantly not as described
• Item damaged in transit (if inadequately packaged)
• Wrong item received

Not Eligible for Return:

• Change of mind or sizing issues (all sales final unless misrepresented)
• Minor wear consistent with listing description
• Issues reported after the 3-day window

For disputes, contact us at support@hushabuy.com. We will review the listing, photos, and communications to mediate fairly. Our decision is final.

8. Prohibited Conduct

Users may not:

• List prohibited or unsafe items (see our Prohibited Items page)
• Misrepresent item condition, authenticity, or safety
• Attempt to complete transactions outside the HushaBuy platform
• Harass, threaten, or defraud other users
• Use the platform for commercial resale operations (occasional selling is fine)
• Create multiple accounts to abuse promotions
• Violate any applicable laws or regulations

9. Account Suspension and Termination

HushaBuy reserves the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, repeatedly receive complaints, or pose a risk to our community. We may also remove listings that violate our policies.

10. Intellectual Property

By posting photos and descriptions, you grant HushaBuy a non-exclusive license to display your content on the platform. You represent that you own or have rights to all content you upload. The HushaBuy name, logo, and platform design are protected by trademark and copyright law.

11. Limitation of Liability

HushaBuy is a marketplace platform connecting buyers and sellers. We are not a party to transactions between users. To the fullest extent permitted by law:

• HushaBuy is not responsible for the quality, safety, or legality of items listed
• HushaBuy does not guarantee that items are as described or fit for a particular purpose
• HushaBuy is not liable for disputes between buyers and sellers
• Our total liability for any claim is limited to the fees paid to HushaBuy for that transaction

Parents should always inspect items carefully and use their judgment about safety and suitability for their child.

12. Third-Party Services

HushaBuy uses third-party services including Stripe (payment processing), EasyPost (shipping), and others. Your use of these services is subject to their respective terms and policies. We are not responsible for third-party service failures or data practices.

13. Privacy

Your use of HushaBuy is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.

14. Governing Law and Disputes

These Terms are governed by the laws of the State of Nevada, USA, without regard to conflict of law principles. Any disputes arising from these Terms or your use of HushaBuy shall be resolved in the courts of Las Vegas, Nevada.

15. Changes to Terms

HushaBuy may update these Terms from time to time. We will notify users of material changes via email or platform notification. Continued use after changes constitutes acceptance of the new Terms.
